Modern Blocks sells art photographs numbered and in limited editions, offered in several formats and mountings. Those photographs will be hereafter designated as "Photos", "Masterpieces", "Product" or "Purchase". The selection offered on the website will change in accordance with the level of stock and the artistic choices.
These General Terms and Conditions of Sale and of Utilization (hereafter designated "Conditions") govern the use of the website www.modern-blocks.com (hereafter designated "Site") and the contractual relations between Modern Blocks SPRL (hereafter designated "Modern Blocks" or "the Company") and each user of the Site (buyer or just user who will be hereafter designated "User", "Buyer", "Customer" or "You") in case of online purchasing. The present conditions are governed by Belgian Law. By using the Site, the User accepts without reserve the Conditions, which are the only applicable, except prior derogation, explicit and written. The Conditions can be modified by Modern Blocks and the User is supposed to know the applicable conditions at the date of her/his purchase or visit. The revised terms and conditions shall apply to the use of our website from the date of publication. Each purchase is governed by the Conditions applicable at the date of the purchase. In approving a purchase, the User accepts without reserve the conditions of sale. Modern Blocks keeps the different versions of the Conditions so that the buyer can send an email to firstname.lastname@example.org to receive the conditions that were applicable when she/he did a purchase.
You must declare having read and accepted the present general sales conditions before placing an order. The validation of your order means you accept these general conditions. The acceptance is made by checking the box next to the link to these Conditions. The payment approval by the financial institution concludes the contract.
Modern Blocks reserves the right to cancel or refuse any order from a customer with whom there was a dispute regarding for instance the payment of a previous order.
The user www.modern-blocks.com must be at least 18 years of age to use the Site; by using it and agreeing to these terms and conditions, you warrant and represent to Modern Blocks that you are at least 18 and guarantee the truth and exactitude of the information provided by yourself.
The Site is supposed to be available 24/7 but Modern Blocks do not warrant or represent that the website or any service on the website will remain available and the Company could not be considered as responsible in case of technical problems or damages due to external fraud intrusion.
Information on the website is updated on a regular basis but Modern Blocks does not warrant or represent the completeness or accuracy of the information published on the Site. In case of mistakes by the Company about a price, Modern Blocks commits itself to apply the lowest price applied on the Site for a similar product (same mounting and size).
All the prices on the website are indicated in euros and inclusive of VAT. They are related to the purchase of a chosen photograph and mounting. The delivery fees are billed separately and depend on the country of the Buyer and the option chosen. In case of delivery to another country than Belgium, the Buyer does import the concerned Masterpieces. In case of delivery outside the European Union, import duty and taxes may be applied. These charges are at the customers own expense. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. Modern Blocks will not be liable for any breach by you of any such laws. You can contact your local customs office for further information before placing your order. The Masterpieces comply with Belgian law and Modern Blocks will not be liable for any breach of the law of the delivery country.
Billing is made on the basis of the price indicated at the date of the order and only if the photograph is still available. Payments are in euro only. The buyer becomes owner of the photograph as soon as the entire payment of the invoice is received by Modern Blocks.
Modern Blocks reserves the right to modify its prices at any moment. However, products will be invoiced based on the tariffs in force when the order was placed.
The purchase is considered as firm and final as soon as the buyer confirms the order. The Site sends a confirmation of the order by email.
In case a photograph would finally appear to be unavailable anymore without previous notice on the website, Modern Blocks will contact the buyer who will have the right either to cancel the order or to have another photograph of an equivalent price.
If there are deficiencies due to reasons of force majeure or false, inaccurate or misleading information provided by the buyer, Modern Blocks will not be liable. In case the responsibility of the Company is proven, compensation will not exceed the amount of the initial order.
The following payment methods are available: Visa, Mastercard or via Modern Blocks gift card.
Payment security is ensured by Stripe company and a SSL certificate is used to guarantee the data protection.
The Site and the payment service provider register all the transactions done between Modern Blocks and its customers. This information constitutes the proof of financial transactions.
Gift cards have to be used in one time and can’t be reimbursed or returned. The value of any gift card you use will be deducted from the total cost of your order. If any balance remains to be spent from the gift voucher, it can’t be used on a future order.
If the payment is rejected by the bank of the buyer and if the financial transaction is not effective, the order and the sale will be canceled.
During the ordering process, the client provides and approves the delivery address details. The delivery address can be different from the billing address. The buyer who mentions the address and names of a third party for the delivery guarantees that he received prior authorization to use these details.
The delivery date depends on the level of stock and on the chosen delivery option. For information purpose, the average production is 5 days. The delivery timescales mentioned on the Site start when the order is validated. It depends on the delivery company so that neither compensation nor order cancellation can be claimed by the buyer to Modern Blocks in case of delay.
Upon the reception of your purchase, it is your responsibility or the responsibility of the third party who receives the parcel to verify shipments and to express any reservations or complaints or even to refuse the parcel in case of clear signs of damage. In such a case, do not sign the delivery receipt, inform the delivery company and contact Modern Blocks within 24 hours. Otherwise, the right to return or exchange the purchased items is no longer valid.
The masterpieces are fragile. Once the delivery receipt is signed, the buyer is responsible of the damages due to an inappropriate use.
The client has a legal cancellation right as stated in the European law. If one of the items purchased on the Site is not suitable for the client, the client has a period of fourteen (15) calendar days, to be counted from the day after the date of delivery, to cancel her/his purchase, without penalty or need for justification. From the notification of the cancellation, the buyer has a period of 14 calendar days to return the photograph to Modern Blocks. This right does not apply to the purchase of gift vouchers or photographs sold in auction or other personalized purchase.
To exercise the right to cancel, you must inform Modern Blocks of your decision to cancel your order by contacting our customer services team (e.g. a letter by post or email or a telephone call) who will give you all the details about the procedure. The photograph to be returned must absolutely be returned properly protected in their original packaging and with the certificate of authenticity, in perfect resalable condition. If the Product was damaged, broken or soiled by the Customer, the right of cancellation will not be valid.
The photographs returned in the conditions described here above will be reimbursed. The original delivery fees will be reimbursed as well. Only return costs will be on your own expense. We will make the reimbursement not later than 14 days after we receive from you the parcel.

The return right is different from the cancellation. It can be applied if the photograph you receive does not conform to your order. In such a case, Modern Blocks will refund the price of the photograph, the initial delivery costs and also any reasonable costs you incur in returning the item to us. Modern Blocks will try to fix the problem but in the case it would not be possible, you will receive a new photograph if the one you chose is still available. If not, you can choose to receive another one of an equivalent amount or to be refunded. We will make the reimbursement not later than 30 days after we receive from you the parcel.
By buying a photographic print, you are only acquiring material ownership of the print for private use. No other rights are granted or implied. Reproduction, dissemination or public exhibition are not allowed. The artist and Modern Blocks remain the holder of the rights on intellectual property.
The Site is the exclusive property of Modern Blocks who gives access to it under the condition that the General Terms and Conditions of Sale and of Utilization are approved by the User. All the elements of the Site are protected by copyright laws. Those elements include, but are not limited to: text, graphics, artwork, user interfaces, software, domain name, visual interfaces, photographs, sounds, logo, computer code (including html code), programs, products, as well as the design, structure, contained on or available through the Website. Unless otherwise indicated, these elements are owned, controlled, and licensed by Modern Blocks. Any use of such elements (commercial use, reproduction, download, copy…) without express written permission is strictly prohibited.
Any User who wishes to insert and use a direct link to the Site must request permission from Modern Blocks.
The present Conditions are governed by Belgian law. In case of litigation, an amicable resolution will first be sought before any legal action is taken. If no amicable agreement is reached, the courts in Brussels shall have sole jurisdiction.

The User may have to create an account in order to place an order or to participate to auctions. The User certifies that login and contact details are correct and will inform Modern Blocks if some changes occur in the future.
If you set up an account on our site, you must treat your login details as confidential. You must not disclose them to any third party. You are responsible of your password and the use of your account.
The account setup will be confirmed by an email sent to the electronic address you provided.
You can ask to deactivate and close your account by sending an email to email@example.com. Your request will be handled within 48 hours.
Modern Blocks has the right to disable any account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Conditions.
The User can subscribe to the Facebook, Instagram or other social networks pages of the Company. By subscribing, the User must comply with the terms and conditions of these social networks.
The personal data you provided are only stored and used internally to handle the orders and to comply with legal rules. It can also be used to offer additional services such as communication (informative letters or emails) or personalized product suggestions according to the preferences you showed on the Site. Your personal data will be stored by Modern Blocks who will not share them with third parties, except with legal authorities if requested and with Modern Blocks’ partners who need it for order execution, payment and delivery purposes.
The User allows Modern Blocks to store cookies on the User’s computer hard drive. They are used to register the User’s visit to our site in order to improve our personalized service to you. However, cookies can be blocked by configuring the internet browser.
Depending on the parameters chosen during the account setup, you may receive commercial proposals from Modern Blocks. If you no longer wish to receive them, you can change the parameters at any time or contact the Company at firstname.lastname@example.org.

Auctions on Modern Blocks consist in linking some photographers with the public. The photographers decide to put some works on sale on the Site. They chose the mounting, the size and they describe the masterpiece. At the end of an auction, the photograph and the best bidder can still decide to confirm the sale or not. Modern Blocks does not intervene in the process and therefore does not play the role of photographer representative.
The buyer and the photograph are supposed to know the legislation about cultural goods and art works, in particular with regard to movement and fraud.
